Case Study – Uxbridge November 2023 – Let Property Campaign
In the letter, HMRC states that the client is a landlord. The client did not do anything with the letter until 6 months later, when HMRC started to chase for the information.
We need to consider how HMRC received the above information? One possible way is that when a property is sold, the Land Registry informs HMRC. HMRC then, via the National Insurance number for the seller, could check the record, date of birth, address of the taxpayer.
If there is more than one address for the taxpayer, that could lead to a prompt by HMRC stating that ‘we have information that you may have rented a property/were a landlord and you may to bring your tax affairs up to date’.
For our client, it was true that they had received rental income for a property that they were letting, but they had not declared this to HMRC by submitting accounts. Our first call to action was to call HMRC and inform them that we will be dealing with this case.
We followed this with the form 64-8 (authorising us to act as agents on behalf of the client). The reason for this is so that HMRC can communicate with us directly, and we can communicate with our client when needed. This ensures that the initial anxiety and stress experienced by our client is reduced going forward as the communication with HMRC is dealt with by us as part of our accounting services.
We gathered all the information required to complete the self-assessment tax returns required by HMRC, from when the property was first rented to when it was sold. We requested information from the client such as rental income and expense statement from the estate agent, mortgage interest paid, any expenses paid by the client personally for the rental property per tax year.
Once we had this, we prepared the profit and loss from the rental property per tax year, prepared the tax calculations per tax year by including all other income earned per tax year in addition to the rental property. Once it had been communicated to the client, the overall tax liability, we completed the disclosure with HMRC via the Let Property Campaign.
The reason for this is that the overall penalties are potentially less compared to filing late self-assessment tax returns, as the maximum penalty for late filing of self-assessment tax returns can be £1,600 per tax year!
One point to note, which HMRC are very precise on, is that once the taxpayer admits that they have to bring their tax affairs up to date, they have 90 days to complete the disclosure and pay the additional tax, penalty and interest per tax year.
Under the Let Property Campaign route, penalties are charged depending on whether it was a prompted or unprompted disclosure, the number of months the disclosure was submitted after the deadline and whether it was deliberately not disclosed, or whether there was a reasonable excuse for the non-disclosure in the first place.
For our client, the penalty range was a prompt disclosure as HMRC had written to them, that they had information, the disclosure was more than 12 months after the deadline per tax year, the client had a reasonable excuse for the non-disclosure in the first place.
The penalty range was 20%-30% per tax year. However, this can be reduced by telling, helping and co-operating with HMRC. The reasonable excuse was that the client was looking after their sick parent, and due to the time taken to care for the family member, the client’s tax affairs were not up to date.
The overall result was that HMRC accepted the reasonable excuse for the non-disclosure of the rental profit per tax year. They did not take the stance that the returns were deliberately not submitted which would have resulted in higher penalties.
